Under this agreement, VEGA (the Lessor) rents the vehicle described herein, including any replacement vehicle, to the Renter. The rental is subject to the terms below and those on the front of the agreement, which the Renter expressly, unconditionally and unreservedly accepts in full.<\/p>\n
For vehicle groups X, A, B, W and K, the minimum age is 21 for credit card holders and 23 for drivers without a credit card. For all other groups, the minimum age is 25.<\/p>\n
A valid driving licence held for at least one year is required.<\/p>\n
Upon acceptance, a deposit for the estimated charges is required at the start of the rental, with a minimum of \u20ac150.00 per day. No deposit is required for holders of credit cards accepted by the Lessor. The minimum rental period is one day (24 hours). Each additional hour is charged at 1\/5 of the daily rate. An overrun of more than three hours is charged as an additional day.<\/p>\n
The Renter confirms having inspected and received the vehicle in perfect condition, to their complete satisfaction and suitable for the intended rental purpose. The vehicle and all accompanying documents, tools and accessories must be returned to the Lessor in the same condition, at the place and on the date specified in this agreement. Otherwise, after the rental period expires, the Renter must pay the normal rental charge and expenses for any loss or damage. The Lessor may repossess and use the vehicle at any time, without notice or the Renter\u2019s consent, at the Renter\u2019s expense, from any location and by any means, if the Lessor considers there is a risk of damage, loss, non-payment of rent or other compensation due. The Lessor may also repossess the vehicle if it has been used in breach of this agreement or beyond the agreed rental period.<\/p>\n
The Renter must compensate the Lessor for theft, loss of or damage to the vehicle, harm to any person (including passengers), and all losses and damage suffered by the Lessor. The Renter is liable for damage caused to the vehicle or others if the vehicle was used in breach of this agreement, unlawfully or contrary to the Greek Highway Code.<\/p>\n
The Renter is liable for partial or total theft or loss unless the Lessor grants a waiver for total theft or loss. This waiver applies only if the Renter accepts the daily charge and conditions of Theft Protection (TPC) at the start of the rental, as defined in the Lessor\u2019s official tariff, and marks the acceptance box on the front of the agreement. The Renter must take all precautions against total theft or loss and use the vehicle in accordance with this agreement. Theft or loss of parts, accessories or equipment (partial theft) is not covered by TPC.<\/p>\n
The Renter is liable for collision or fire damage unless Collision Damage Waiver (CDW) is accepted by marking the acceptance box and paying the daily charge. CDW does not release the Renter from liability if the vehicle is used in breach of this agreement, particularly article 7. A minimum damage charge remains payable under the official tariff or the front of this agreement unless Full Damage Waiver (FDW) is accepted and paid for.<\/p>\n
Neither CDW nor FDW covers damage to the underside, tyres or wheels, or damage during loading, unloading or transport by ship, train or other means without the Lessor\u2019s prior written consent.<\/p>\n
Unless otherwise agreed, the Renter must pay the following at the end of the rental:<\/p>\n
The daily rental fee for the entire rental period.<\/p>\n
Mileage charges, unless otherwise agreed, at the per-kilometre rate in the Lessor\u2019s official tariff.<\/p>\n
Mileage is calculated from the odometer readings at collection and return. If the odometer does not work, the charge is based on the distance travelled by the Renter.<\/p>\n
Refuelling charges if the vehicle is returned with a different fuel level from collection; charges for Theft Protection (TPC), Collision Damage Waiver (CDW), Personal Accident Insurance (PAI) and Full Damage Waiver (FDW); and other charges provided for in this agreement or the official tariff. If the vehicle is not returned with the same fuel level, the Renter also accepts the Refuelling Service Charge specified in the official tariff.<\/p>\n
Taxes, duties and other expenses relating to the rental.<\/p>\n
The Lessor\u2019s costs, including legal fees and default interest, incurred in recovering payments due under the rental or repossessing the vehicle.<\/p>\n
Fines, penalties, court costs and other expenses imposed or to be imposed on the Lessor because of the Renter\u2019s unlawful use of the vehicle. The Renter or additional driver named on the front of the agreement remains responsible for unlawful acts.<\/p>\n
The cost of repairing or replacing damaged tyres or wheels, repairing underside or other damage, and compensation for loss of the vehicle, unless the relevant waivers have been accepted and their conditions satisfied under article 5.<\/p>\n
Delivery or return charges, including returning the vehicle to a different location from the one stated on the front of the agreement without the Lessor\u2019s written consent, at the rate in the official tariff. An Airport Service Charge also applies when the vehicle is rented from an airport branch.<\/p>\n
The Renter accepts that discounts will be withdrawn if payment is not settled within the agreed time. All charges are subject to the Lessor\u2019s final audit and are accepted in full under this agreement.<\/p>\n
The Renter must take proper care of the vehicle, maintain it in good condition, check its mechanical condition, oil, water and tyres, and act prudently. No repairs by the Renter or another person are permitted without the Lessor\u2019s prior consent. The vehicle must not leave Greece or be transported by train, ship or other means without the Lessor\u2019s prior written consent. The vehicle must not be used:<\/p>\n
To carry people or property for payment;<\/p>\n
To propel or tow a vehicle, trailer or other object;<\/p>\n
To participate in or follow rallies;<\/p>\n
For subletting to a third party;<\/p>\n
For purposes contrary to Greek law;<\/p>\n
While the Renter or additional driver is under the influence of alcohol, hallucinogens, narcotics, barbiturates or any substance affecting awareness or reactions;<\/p>\n
In breach of customs, traffic or other regulations;<\/p>\n
By anyone other than the Renter or an additional driver for whom the daily additional-driver charge in the official tariff has been accepted;<\/p>\n
To transport heavy luggage, flammable materials, staining or foul-smelling goods, narcotics or similar items;<\/p>\n
For illegal transport of residents or foreign nationals, or other unlawful acts.<\/p>\n
To extend the rental, the Renter must notify the Lessor in writing at least twenty-four (24) hours before it ends and obtain written approval. Failure to do so entails civil and criminal liability for unlawful use and possession. An extension remains subject to both the original agreement and the extension agreement, for the original vehicle or any replacement.<\/p>\n
The Renter expressly agrees that the Lessor is not responsible for loss or damage suffered by the Renter or third parties during the rental and that no claim will be brought against the Lessor on that basis.<\/p>\n
After an accident or another incident, such as fire or theft, the Renter and any additional drivers must immediately:<\/p>\n
Avoid acknowledging liability, fault or third-party claims, directly or indirectly;<\/p>\n
Record witnesses\u2019 names and addresses, the other party\u2019s name and address, and details of any vehicle involved in the collision;<\/p>\n
Notify the police to investigate third-party liability and arrange care for any injuries;<\/p>\n
Contact the Lessor by telephone or another means, such as fax;<\/p>\n
Obtain all relevant information from third parties;<\/p>\n
Photograph the scene and the vehicles involved, if possible. The Renter must complete and sign an accident or theft report at the nearest branch within twenty-four (24) hours and provide all relevant documents and information to the Lessor. Theft or loss of the vehicle must also be reported in writing to the nearest police station within twenty-four (24) hours.<\/p>\n
The Lessor provides the Renter and any additional driver with insurance coverage by insurance companies of its choice for death or injuries of third parties, passenger or not, of Vehicle (the Vehicle driver is excluded) to the total maximum amount of \u20ac1 000 000 and for material damages of third parties except Lessor\u2019s vehicle caused on objects inside or on vehicle to the total maximum amount of \u20ac1 000 000 provided that they do not violate any term of this agreement.<\/p>\n
Third-party insurance applies only to people using the vehicle with the Lessor\u2019s permission, under an insurance policy whose terms are available for inspection.<\/p>\n
The Renter, authorised additional drivers and other passengers are not covered by Personal Accident Insurance (PAI) unless the Renter accepts it at the start of the rental by initialling the acceptance box on the front of the agreement and paying the daily charge. Acceptance is for the cover provided by the Lessor\u2019s personal accident policy, as described in the official tariff.<\/p>\n
Luggage is not insured. The Renter is responsible for loss of or damage to property, whether their own or another person\u2019s. The Lessor is not responsible for such loss or damage during the rental or after the vehicle is returned.<\/p>\n
The Renter consents to electronic storage of their personal data. The Lessor is authorised to use this data if the Renter makes incorrect statements during the rental or breaches the agreement, and to disclose it to the national authorities where a criminal or other offence is suspected.<\/p>\n
The vehicle remains the property of VEGA. This agreement is solely a rental agreement and does not make the Renter an agent of the Lessor. The Renter acquires no rights other than those stated here.<\/p>\n
All additional drivers are jointly and severally liable with the Renter during the rental.<\/p>\n
A representative signing this agreement on the Renter\u2019s behalf is also jointly and severally liable with the Renter.<\/p>\n
This agreement supersedes earlier or oral agreements between the parties.<\/p>\n
The Lessor cannot waive rights arising under the law or this agreement.<\/p>\n
Changes to this agreement are invalid unless agreed in writing.<\/p>\n
These terms apply to the original agreement, any extension and any replacement vehicle.<\/p>\n
If a copy differs from the original held by the Lessor, that original prevails.<\/p>\n
The parties acknowledge and accept that all terms are essential and fundamental to the purpose of this agreement.<\/p>\n
This agreement is governed by Greek law. Disputes between the Lessor and Renter arising from it are subject to the exclusive jurisdiction of the courts of Athens, Greece.<\/p>","protected":false},"excerpt":{"rendered":"
